The American Chemistry Council has serious concerns about the impact to its members’ business.
I believe the article is wrong about the current state of reciprocal switching in the US (as opposed to in Canada). Under current regulations, the STB – and formerly the ICC – requires a showing of anticompetitive conduct by the incumbent railroad before it will order reciprocal switching – a standard that I believe has never been met. (See Frank Wilner’s discussion in A Primer on Reciprocal Switching - Railway Age) Shippers would be delighted if the regime described in the article were actually in place.
