An officer who issued a vehicle inspection report that is a passing report issued after a inspection. Level 1,2,3 and vehicle is determined a pass. If the officer stated in notes on the vehicle inspection that the driver had other violations, ie… Phone use, following to close, speeding, etc… Officer doesn’t issue citation for alleged violations, driver had no recourse to challenge officers statements on inspection report. Driver recieves points against his FMCSA record. This is a recurring habit because officer does not have to appear in court if challenged as he would if it was a citation.
This practice needs to stop. The FMCSA should change the rule pertaining to the driver having no recourse. It should be considered unconstitutional under U.S. law. I welcome any comments from anyone concerning this topic.
