California is preparing to reissue approximately 17,000 non-domiciled commercial driver’s licenses it planned to revoke after federal enforcement pressure, setting up what may become the most significant federal-state confrontation over CDL authority in decades.

If you don’t know what FMCSA is you don’t have a clue
I have no favorite state. I believe in what works for a state, based on who the people elect, is their business. Until that state affects others lives. After 25 years of driving OTR, I dont like most truckers in general. Not only for their driving, but the trash they say over cb. Its an embarassing profession. Due to the ignorance that permeates the industry. I have no love for non-domiciled drivers. But not entirely for the reason the mostly ■■■■■■■■■■ industry of trucking. Yes, most of them, I wouldnt let them drive a go kart, let alone a rig. Thats not to say there isnt a tremendous amount of bad American drivers. But there is no need to make a bad industry worse. Trucking has been terrible for decades. Crashes and deaths have records still standing from the 80s. Which is why we have CDLs. You still have American clowns behind the wheel of rigs. Why? Because vast majority of people behind the wheel of passenger vehicles are HORRIBLE people. If you see someone obeying the law or not risking a crash, it would be a miracle. Just straight clownery out here. So, those bad passenger vehicle drivers, get CDLs. And you now have that same poor ash driver, driving rigs. Its why you now see so many truckers no longer doing the things that at least gave a resemblance of professionalism. No signals to change lanes, exit or merge. Changing lanes in front of another rig, leaving 2 seconds distance between rigs. Several trucks driving within seconds of one another, in line, the length of trains. Its pathetic. Adding poorly trained people. Many of which can barely read English, let alone speak it. Just makes the job and safety for others extremely challenging. California is wrong for this. And its all about money.
That’s fine. California can issue them all they want and if they travel I-40 through Texas, Oklahoma, or Arkansas we will place them out of service and arrest them if they are here illegally. Better get a map and run I-70 or I-80.
I hate to say it but after 34 years of driving trucks across America and Canada, I have to say that many of today’s drivers make a box of $hit look like a Quantum Computer. Call me ■■■■■■ (I’ve been called worse, my father was a Marine, battle tested at the Chosen Reservoir) for this observation but I’m convinced that IF law enforcement would do their job, and start writing tickets to the drivers who refuse to move out of the middle lane, as well as writing parking tickets to the drivers who park ■■■■■ nilly all over the driveways of truck stops, many of these “drivers” would self deport if they had to face the consequences of their actions instead of getting the free ride anti trumpets are giving them.
It’s called “federalism.” If California paid exclusively for their roads and INTERSTATE highway system by fuel and road use taxes alone, they could issue CDLs to ANYone they wanted who would be restricted to JUST those roads.
BUT, “making interstate commerce regular” is the job of congress, which instituted laws, and bureaucracies to attend to those laws and regulations through the DOT, NHTSA and so on.
IOW, ANY roadway or driver must meet federal standards.
Pretty sure that’s how the courts have said it works.
President Trump should order the DOT to halt any/all funding to California for roads/bridges/infrastructure so long as the state is issuing CDL’s to non-qualified illegal aliens.
Similarly, since they won’t open voter rolls, or SNAP registration data for federal review, they should lose all funding for THAT as well.
The state is also not complying with ICE or CBP, as if it’s their own country, not part of the USA.
Our United States had this kind of insurrection once before. It took less than five years to settle (more or less, reconstruction was a mess and resentments live on to today), I’m sure President Trump can put a lid on it in a month or less, sending in federal troops and arresting Governor Newscum would be a good start.
Thank you Mr. Rob Carpenter for a concise, articulate article on this subject. It is refreshing, as it was not biased, as most of what Freight Waves has to say on this subject is. I even have had a Freight Waves editor Photoshop me as a clown in one of my comments on her article. Sad they actually pay her for this. I am a veteran driver with over 33 years out here and millions of accident free miles. I have seen this industry ruined by foreign low wage earners, driving sub standard equipment, having sub standard saftey scores, taking freight rates down the tubes. They are granted a temporary work visa, over stay them, then some how think they have some kind of right to stay here. These drivers think they have more rights than an American driver or company. I am sick of hearing how they are losing their company or truck. Simple fix. Hire an American driver. Problem solved. We do not need them. We have plenty of Americans here for these jobs. There is no driver shortage. There is a pay shortage due to these people being in this industry. Retrain them for freight analytics, or the non asset based logistical side of this industry. Maybe even for editors who like to use photoshop. I am sure those 200,000 won’t affect them. Thank you Secretary Duffy for putting American drivers first. It is long over due.
